Hall of Fame quarterback Dan Marino has filed his own NFL concussion lawsuit. Sammy Sosa Cubs Jersey . Marino, along with 14 other players, filed the lawsuit on May 28 in the U.S. District Court for the Eastern District of Pennsylvania. Marino joins a little under 5,000 retired NFL players and their families that have sued the league across approximately 225 concussion lawsuits. There have been many notable players that have filed lawsuits, including Tony Dorsett, Eric Dickerson, Mark Rypien, Tony Mandarich, Art Monk, Jim McMahon and Jamal Lewis, as well as the estate of the late Junior Seau. None, however, are as well known as Marino. The key allegation raised by Marino is the NFL concealed information. He is arguing that the NFL knew of the long-term neurological impact of headshots but failed to share those findings with the players. This issue of fraudulent concealment was also alleged in the other concussion lawsuits so its not new. Its tough to know if Marino will succeed as everything turns on the evidence presented at trial. To win, he will need to show that the NFL had key and important information about the long-term and devastating impact of headshots and concealed it. The NFL, however, has certain defences available to it. First, it can argue that players were aware of the risk associated with playing football and they agreed to those risks each time they stepped onto the field. The NFL would also maintain that they didnt conceal anything. As well, the NFL could point out that no one can say for sure what caused a players dementia, and even if it was caused by repeated headshots while playing football, how much of that damage was sustained outside the NFL in places like college or high school ball. So what caused the dementia and when it was caused become key issues. The NFL can also argue that Marinos lawsuit doesnt belong in court in the first place, but rather should go to arbitration. The collective bargaining agreement provides that issues of player health and safety go to arbitration and not court. On the flip side, Marino would argue that since this case involves fraud in the form of concealment, it properly falls outside of arbitration and within the jurisdiction of the courts. Bottom line is this: both sides face challenges in this case and thats where we generally see settlement. All this is probably moot, as the league is working on finalizing a global settlement of these cases. You may recall that back in July 2013, the league announced it had settled the concussion lawsuits with the players. The negotiated settlement was for $765 million and would bind every retired NFL player, of which there are about 19,000. You should note, though, Marino is included among these players. So that means that Marino didnt need to file the lawsuit at this time. As well, while settlement was indeed announced, it was not finalized. Before the NFL can consider the case closed, the Court has to approve the terms of settlement. The problem is that on two separate occasions the Court has rejected the settlement on the basis that there is insufficient money to pay all players. As well, even if the Court were to approve the settlement, any of the 19,000 players would have the option to opt-out of the settlement agreement. If a player believes that he can do a lot better filing his own individual lawsuit, he would tell the court and the NFL thanks but no thanks, Im headed to court. The Marino lawsuit may suggest that he is tired of waiting around for a payout from the proposed settlement and wants to take matters into his own hands. Whatever Marinos motivation, these concussion lawsuits are likely to continue for years. In the event a global settlement is approved by the Court, it seems likely that a number of players will opt out and file their own lawsuits. Now the quasi-government agency that runs Bankers Life Fieldhouse, home of the citys NBA team and WNBAs Indiana Fever; Lucas Oil Stadium, home to the NFLs Colts, and the citys convention centre will spend in excess of $10.8 million annually over the life of the deal. The contract runs for 10 years and includes three one-year extensions with the Pacers having the option for the first of those years. The last two will be mutually agreed upon. In return, the Pacers have agreed to stay at Bankers Life Fieldhouse and will give city leaders the "right of first offer" in the event the 79-year-old Simon dies and his heirs attempt to sell the team. The provision means the city could designate a new potential owner and that person would be able to make the first offer on the team or could match an offer from someone else. "With this agreement, one of our citys most important facilities will get some critical upgrades and continue to be home to some of our most amazing events," board president Ann Lathrop said after the vote. TORONTO - Logan Couture doesnt have to look far to be reminded of the San Jose Sharks playoff collapse against the Los Angeles Kings. Raptors Jersey . His surgically repaired right hand still has scars from last months surgery, and the recovery has been slow. He expects the hand, injured in a fight with Kings centre Mike Richards, to be OK by training camp. Doughty doesnt chirp his good friend, but that doesnt stop Couture from thinking about the painful first-round series loss. "I think every time I see hockey on TV or read about it in the paper," he said. The Sharks were in command of the series, up three games to none. But they proceeded to become the just the fourth team in NHL history to blow that lead. The Kings won the Cup, and the Sharks were left to wonder what went wrong. Couture doesnt ponder what he and his teammates couldve done differently. The thoughts are more simple than that. "I just think about how much it hurts," he said Thursday night at Dominic Moores Smashfest charity event. "The feelings arent going to go away — probably never. Its just something that sticks with you for a long time." In time, Couture thinks the collapse should serve as motivation for the Sharks who remain. For now, at least, that includes captain Joe Thornton and veteran winger Patrick Marleau, whose new contracts start next season and include full no-move clauses. San Jose general manager Doug Wilson has talked about rebuilding and going younger. In the process the Sharks traded 38-year-old defenceman Dan Boyles free-agent rights, traded 34-year-old defenceman Brad Stuart and bought out 33-year-old winger Marty Havlat. In free agency, the Sharks signed enforcer John Scott in an effort to "act as a deterrent and help keep teams and opposing players honest," according to Wilson. The vast majority of the roster looks similar to the one that finished the playoffs, though San Jose hopes to have defenceman Marc-Edouard Vlasic back after his injury and will move Brent Burns back to the blue-line. "We knew something was going to happen. Every year changes happen," Couture said. "Well see what happens going forward. Some things may happen, some things may not, so well see." One thing that may happen in the not-too-distant future is Couture becoming the captain. The Sharks took the "C" off Marleau four years ago and he has continued to play and produce, so that concept isnt far-fetched for Thornton, as well. Couture, who served as captain of the OHLs Ottawa 67s, has had conversations with Wilson this summer but said he had not been specifically asked to increase his leadership role. "I think its just expected," the 25-year-old Guelph, Ont., native said. "I think each year you play more with an organization youre expected to take on more of that role. Those are kind of the things that dont have to be said." Couture will begin his new US$30-million, five-year contract this season and hopes that his tenure in San Jose is a long one. With that, he anticipates a larger role in the locker-room and on the ice. "I think I learned a lot from the leaders on our team in San Jose the last couple of years and taking small things from them and try to be a leader as much as I can with our team with our young guys," Couture said. Machado lifted a bases-loaded sacrifice fly in the 10th inning and the Orioles beat the Seattle Mariners 3-2 Sunday. The Orioles took three of four in the series, twice winning in extra innings. Baltimore is 11-3 in extras this season, including six straight wins. Manager Buck Showalter said Machado had a "stick-your-nose-over-the-plate-and-get-it-done" at-bat. "They got runners on at the end and they were able to get the sac fly, which was huge," Ackley said. "We just didnt take advantage and they did."
